Who is most likely to win custody?

I recently got out of jail due to a weed posession and a few days ago hit my baby daddy n he got a PPO (personal protection order) no body has official custody and I want my daughter. My baby daddy has a record of assault 4x & a DUI ... who would most likely get custody of my daughter.
